Mining Law: In Search of Sustainable Mining

Mining is an activity that generates inputs to different production chains, making it essential for any country’s development. However, causes environmental, economic, and social impacts must be considered. The Law provides guidelines, through laws regulations, so the can carried out in environmentally, economically, socially sustainable way. In this paper, analysis was conducted of application some peculiar characteristics Brazilian (locational rigidity, priority granting, among others) according parameters established Federal Constitution, Code its updates, National Department Mineral Production, Environment Ministry, Mines Energy Ministry normative acts. Moreover, Superior Court Justice Jurisprudence analyzed understand how applied, practice. It verified legislation not perfect, but has mechanisms protect benefit miner, society, environment. there are many shortcomings like lack speed judging processes flaws applicability principles compromise sustainability activity’s development, especially regarding environmental liabilities left after mine closure.
